We are currently in the midst of a series on Mediation, a way to try to avoid conflict in the workplace reaching a point that stricter legal measures need to be introduced. In this series, we have so far learned what Mediation is about and why it is employed and we have also learned about the power and the benefits of Mediation. Having decided that Mediation is the way to go and understanding its benefits, we continue with the next step which is to look into the actual process of Mediation in avoiding workplace conflict - and gain some insights into the mediation process. In so doing we will see how it aids in avoiding and resolving workplace conflict and we will explore the stages and techniques used to facilitate successful mediation. So, what are some of the effective mediation techniques used in the workplace?

Look at both sides – This is essential to ensure that both parties feel that you are remaining squarely in the middle of the disagreement and not taking sides. Impartiality is critical and if one side’s viewpoint has to eventually be taken over the other to resolve the dispute, ensure that sound reasoning behind the decision is presented.

Give equal and adequate time  - Give full freedom of speech and equal time to both parties. This is also about ensuring that both parties come to the table feeling equally heard. Also, ensure there is enough time to resolve the issue – a rushed mediation is a pointless one if no resolution is reached.

Create a respectful solutions-driven work culture - If Managers themselves always show respect to other parties when discussing difficult scenarios, never losing their temper or displaying negative body language, then this can be expected of employees too.

Set a good example and throughout the year teach the importance of ethics and respect to your team members. Try to create a culture of team players who resolve conflicts themselves respectfully and quickly – thereby also respecting the business!

Set out to find a solution – At the outset of the mediation, make it clear to both parties that this is not a forum for conflict or name-calling but is to be conducted with the sole objective of finding a solution. Then ask the right questions that lead to that solution – always seeking a win-win outcome.
